1. Your agreement with the operator
These terms apply to Pokerista Academy (“Pokerista”, “we”, “us”), including its lessons, scenarios, simulations, hand analysis, learning progress and AI Coach. You can reach us using the details on the Contact page. Review these terms before creating an account or buying a membership.
By creating an account, you agree to these terms. The Privacy Notice explains how personal data is handled; accepting these terms is not consent to marketing or optional tracking. Any purchase also includes the price, billing interval and supplier terms displayed at checkout.
2. Eligibility and account security
You must be at least 18 years old and legally able to enter into this agreement. Use the service only where it is lawful to do so. Pokerista does not determine whether gambling outside the service is legal for you or verify your eligibility to participate in it.
Provide accurate account details, protect your sign-in credentials and do not share or sell your account. Tell us if you suspect unauthorized access. You are responsible for activity you authorize; this does not remove rights you may have concerning unauthorized transactions or our security obligations.
3. Learning only; no gambling or personalized advice
Pokerista is not a gambling app and does not offer real-money games, betting, deposits for play, cash-outs or monetary prizes. Simulated chips, balances, buy-ins, winnings and tournament prizes are fictional learning units with no monetary value. Subscription fees pay for educational access only.
The content explains poker concepts using examples and assumptions. It is a general educational guide, not personalized gambling or betting advice, a recommendation to wager money, or a service for directing decisions during live play. Do not use Pokerista for real-time assistance in an external game or to break another platform’s or venue’s rules.
Practice scores, expected-value calculations, ranges and simulated results do not predict results in real games. We do not guarantee accuracy, profit, improved performance or any specific outcome. AI can produce incorrect or incomplete explanations. Read the Educational Disclaimer as part of these terms.
4. Permitted use and your submissions
We grant you a personal, limited, non-exclusive, non-transferable right to access the learning content included in your plan while your account and access remain valid. Pokerista and its licensors retain rights in the software, designs and content. Statutory exceptions and rights remain unaffected.
You retain any rights in material you submit. You permit us and our service providers to store and process that material to provide the features you request, such as saving a hand or generating a Coach response, as described in the Privacy Notice. This is not a transfer of ownership.
- Do not submit information you have no right to share, another person’s private data, payment credentials or sensitive personal information. Remove identifying details from hand histories.
- Do not copy or commercially redistribute course materials without permission, bypass access controls or usage limits, exploit errors, scrape private data, introduce malware or disrupt the service.
- Do not use the service for unlawful activity, harassment, fraud, cheating or real-money gambling transactions.
5. Free and paid access
Features and usage limits depend on your plan and are shown before purchase. Paid memberships may renew automatically at the interval and price confirmed at checkout until cancelled. Our payment provider handles available paid checkouts as merchant of record, under the supplier terms identified there.
Review the total, taxes, currency, renewal terms and any trial conditions before paying. We will provide notice of material price or subscription changes as required by applicable law. A change will not remove rights relating to an already purchased service.
You can manage an active subscription through Membership and the payment provider’s customer portal. Our 14-day first-payment refund promise, cancellation, withdrawal and service remedies are explained in the Refund Policy. Signing out, clearing cookies or deleting a Coach conversation does not cancel a subscription.
6. Service changes and account restrictions
The service may need maintenance, security updates and corrections. Some features depend on third parties and may be temporarily unavailable. We will meet any mandatory standards and remedies that apply to paid digital services.
We may restrict access where reasonably necessary to address a material breach, security risk, fraud or a legal requirement. Where appropriate, we will explain the reason and offer a way to raise a mistake; urgent restrictions may come first. Contact us if you believe a restriction is incorrect.
You may stop using the service at any time. Use the cancellation process for recurring billing and the privacy-request process for account deletion; these are separate actions. If we discontinue paid access, your applicable refund and consumer rights remain in place.
7. Responsibility and mandatory rights
Use educational material critically and check assumptions. External decisions you make are your own. We do not accept responsibility for gambling losses merely because you studied an example here; this does not exclude any liability that the law does not allow us to exclude.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Nothing removes mandatory consumer rights, rights to digital-service remedies, or protections under applicable privacy law.
8. Questions, disputes and updates
Contact the operator first if you have a concern so we can try to resolve it. You keep any mandatory right to bring a claim in a competent court, including protections that apply in your country of residence. These terms do not impose mandatory arbitration or waive class-action or statutory complaint rights.
We may update these terms as the service or legal requirements change. The version date identifies the current text. Material changes will be brought to your attention, and renewed agreement will be requested where required. Changes do not retrospectively take away accrued consumer rights.
